In order to debate an issue like this, you need to understand what a torrent site is and how it works. Torrent sites provide links, and as Legion said, they provide it just like Google does. What the users do with that information is their business. In America sharing information and/or links is not illegal or censored (for the most part), though I'm not certain about the laws in other countries.
The Pirate Bay clearly states their usage policy on their website,

If the RIAA, or whoever else, were to successfully pass a law that shut down torrent sharing sites, they would also be responsible for any site that provided information and/or links regarding illegal materials on the internet.
