It's not about song choice - I don't think you understood my question. Publishing work with someone else's music - for a $1,000 payment - and being able to do so legally without recourse, is what the question was about. |

There would also be a cost attached to 'performance' use of the music, which would include viewing or downloading on the Internet. Things are additionally complicated when you consider that a track from a CD has two separate copyrights - one for the song (usually owned by the song publisher) and one for the recording (usually owned by a record label). Sometimes the publisher and the label will be one and the same, but not always. The same problems arise for ANY video that you put on the Web - so your other videos, Danielle, are a little bit naughty in their use of music But because they are small-scale projects for a fairly small audience, they are unlikely to ever cause problems. The worst that would ever be likely to happen would be a demand from the copyright owners for you to remove the video from Youtube etc.Scale is very important - the bigger it gets, and the more widespread it is, the more likely it is to attract the attention of music biz lawyers (and I would suggest you do NOT want to screw with music biz lawyers). If you think it might be a problem, there are various ways of avoiding trouble. 1. Use a track by an independent/DIY band, who own their own copyrights and are willing to let you use their song for free or for a minimal fee. 2. Buy some royalty-free music - this is (mostly instrumental) stuff that you can buy for a few dollars and then use in whatever productions you want for no further fee. I write a fair bit of this type of stuff - Chris Worth Productions is one example where you'll find some of my music. 3. If you really want to go for it, you could hire someone to write an original soundtrack for your video. Again, I do some of this type of work, so if anyone is interested in this option, feel free to contact me ![]() |

I appreciate the input - but my previous movies were not published for any sort of monetary gain - so I don't think there is anything "naughty" about it.
![]() YouTube now has a feature that searches for "third party content" It's a search done by artists & record labels to identify their music in movies. I've been contacted both by YouTube and record labels many, many times about having "third party content." Each & every time they have allowed my movies to stay on my site - taking no issue with me using their songs. This contest, however, for whoever wins & for Sammy Sosa as well - could pose a problem for copyright issues - hence why I asked ![]() re: "Royalty free Music" ... lol there's a reason that I don't use it. Nobody knows the songs - music - beats .. therefore taking away from the entire movie experience. I like to use music everyone can relate to and ocassionally sing along with ![]() If I do decide to throw my hat into this contest - much like my 12 days of EU xmas - the song will be original baby ![]() Anywho .. have fun with the contest Sammy ! |

Little details about "fair use" often vary between countries. Here in the UK there's not really any such thing as "fair use" in the law, so any use of copyright music without permission is a legal breach of copyright (though may not be enforced as such). In the USA, there is a "fair use" portion enshrined into the law, though I'm not sure what qualifies for it. Of course on the Internet you need to consider things internationally, which makes the whole business a lot trickier ![]() |

![]() Was just trying to think ahead - as I don't like to be in trouble ever ! I'm still wondering what's in it for Sammy - seems a little weird to have a player put up $2,000 of their own money to promote MA. I guess only time will tell Good luck to everyone who "competes." |
